Terms & conditions
The terms under which you use the Sportlist platform. Each article starts with a brief summary.
Article 1. Definitions
the terms you'll encounter in these conditions — Consumer, Platform, Provider, Gym Membership, Workout — are explained below.
- Consumer: a natural person not acting for purposes related to their trade, business, craft or professional activity.
- Sportlist.nl, 'Us', 'Our', 'We': Sportlist.nl B.V.
- Platform: the website/app where you find Providers, Gym Memberships and Workouts, owned or operated by Sportlist.nl.
- Provider: the person or organisation whose sports-related product or service is listed on the Platform, including but not limited to the owner of a sports club or association.
- Sports experience: the actual use of the class, location, workshop, individual or group training, as well as any other activity or facility the Provider offers access to.
- Gym Membership: the membership at a Provider that, in exchange for periodic payment, grants the right to use the Provider's services.
- Workout: the class, location, workshop, individual or group training, as well as any other activity or facility the Provider offers access to.
- Website: the Sportlist website accessible at www.sportlist.nl.
Article 2. About these terms
these terms apply to use of the Platform. If a clause is invalid, the rest remains in force.
- These terms apply to the use of this Platform.
- If anything in these terms is (or becomes) invalid or unenforceable:
- it will still be enforced to the fullest extent permitted by law;
- you remain bound by all other provisions of these terms.

Article 4. About Sportlist.nl
Sportlist provides the platform, not the gym membership itself. You take out the membership with the Provider.
- When you find a sports club, gym membership or workout on the Platform, Sportlist.nl provides the Platform (and is responsible for it), but not the gym membership or workout agreement, nor the sports experience itself.
Article 5. Our platform
we do our best to show accurate info, but much of the data comes from Providers. A listing is not an endorsement.
- We take reasonable care in providing our Platform, but cannot guarantee that everything on it is accurate (we receive information from Providers). To the extent permitted by law, we cannot be held responsible for any errors, interruptions or missing information — but we do everything we can to correct them as quickly as possible.
- Our Platform is not a recommendation or endorsement of any Provider or their products, services or facilities.
- We are not a party to the terms between you and the Provider.
Article 6. Measures against unacceptable behaviour
in case of fraud, abuse, inappropriate or unlawful behaviour we may refuse you access to the Platform or customer service.
- We reserve the right to restrict your use of our Platform or customer service. We only do this if there is, in our view, a good reason, for example:
- fraud or abuse;
- non-compliance with applicable laws or regulations;
- inappropriate or unlawful behaviour (violence, threats or privacy infringement) towards us, partners or third parties.
Article 7. Limitation of liability
we are only liable for costs that are a direct result of our fault. Consumer law always applies.
- To the extent permitted by mandatory consumer law, we are only liable for costs you incur as a direct result of our failure. We are — to the extent permitted by law — not liable for, for example:
- indirect loss or indirect damage;
- inaccurate information about a Provider;
- a product, service or action by a Provider or other business partner;
- an error in an email address, phone number or credit card number (unless it is our fault);
- force majeure or an event beyond our control.
- If you breach these terms or those of the Provider, then — to the extent permitted by law — we are not liable for any costs you incur as a result and you have no right to a refund.
- We make no promises about the products and services of Providers (except as expressly stated in these terms). Making the right choice is your responsibility.
- Nothing in these terms confers any rights on any third party other than the Provider.
- You may be protected by consumer laws and regulations that guarantee rights which cannot be removed by business terms. In that case our liability is governed not only by these terms but also by applicable consumer law.
Article 8. Contractual relationship
you take out the membership directly with the Provider — Sportlist is not a party to that agreement.
- When you take out a Gym Membership, this is directly with the Provider. We are not a 'contractual party' to your gym membership or workout agreement.
- Sportlist.nl owns and operates the Platform.
- This Platform shows Providers with both commercial and non-commercial relationships and does not necessarily display all of their products or services.
- Information about Providers (facilities, house rules, opening hours) and their Gym Memberships and Workouts (prices, terms, notice periods) is based on what they share with us and what we obtain from publicly accessible sources. Providers are responsible for ensuring this information is accurate and up-to-date.
Article 9. Our role
Sportlist is a discovery platform; not a seller, not a contracting party. Information on the Platform confers no rights.
- We offer the Platform where Providers can make their sports club, gym memberships and workouts discoverable and promote them, and where you can search and compare Providers, gym memberships and workouts.
- A gym membership or workout is not concluded on this Platform, but via the Provider.
- Since no agreement is concluded on this Platform — the Platform aims to inform — no rights can be derived from any (correct or incorrect) information shown on the Platform.
Article 10. Provider terms
the Provider's terms apply to your gym membership, not those of Sportlist.
- When agreeing to a gym membership or workout you don't enter into an agreement with this Platform, but with the Provider. The applicable terms are therefore those of the Provider.
Article 11. Intellectual property rights
all rights to the Platform belong to Sportlist (or its licensors). We may use photos you upload; you remain responsible for their content.
- Unless stated otherwise, all rights to our Platform (technology, content, trademarks, look & feel) belong to Sportlist.nl (or its licensors). By using the Platform you agree to use it solely for its intended purpose and to the conditions in 11.2 and 11.3.
- It is not permitted to monitor, copy, scrape, crawl, download, reproduce or otherwise use anything on our Platform for any commercial purpose without written permission from Sportlist.nl or its licensors.
- By uploading a photo to our Platform you confirm that the photo meets our criteria and that:
- the photo is truthful;
- the photo contains no viruses;
- you are entitled to share the photo with us;
- we may use the photo on the Platform and for commercial purposes (including in a promotional context), worldwide and without end date. If you later indicate that we may no longer use the photo, we will consider that reasonable request.
- the photo does not infringe on the privacy rights of others;
- you accept full responsibility for legal claims against Sportlist.nl in connection with the photo.
- Sportlist.nl is not responsible or liable for any photo uploaded to our Platform. We may remove any photo at our own discretion.
Article 12. Complaints procedure
have a complaint? Email us at contact@sportlist.nl — we'll resolve it together.
- Have a complaint? Let us know as soon as possible. For example if you encounter incorrect information on the Platform. You can also turn to us with questions about finding and comparing Providers, gym memberships and workouts.
- We'd like to hear complaints about our service or use of our Platform directly. Contact our customer service at contact@sportlist.nl.
Article 13. Changes to the terms
we may change the terms. We will communicate or publish every change — the most current version is always on this page.
- We have the right to change these terms at any time.
- The changed terms only take effect after we have communicated or published them (e.g. on our Website). We always indicate the period within which the change takes effect. The changed terms replace all previous versions.
- The latest version of these terms can be found on our Website.
- We file these terms with the Dutch Chamber of Commerce. On request we will send you a copy free of charge.
Article 14. Disputes
Dutch law applies. Disputes are submitted to the court in Amsterdam unless the law dictates otherwise.
- Dutch law applies to disputes between you and Sportlist.nl.
- If we can't resolve it together and the complaints procedure (article 12) also offers no solution, you have the right to start proceedings before a competent court.
- All disputes between Consumer and Sportlist.nl are submitted to the competent court in the Amsterdam district, unless mandatory law dictates that the dispute must be brought before another court.
